Terms and Conditions

The Catholic Diocese of Christchurch (Diocese) welcomes users to use its websites and social media properties.
These terms and conditions (Terms and Conditions) apply to all of the Diocese websites (whether permanent or temporary), including the following websites: chchcatholic.nz, cyt.org.nz, chchceo.org.nz, cathsocservs.nzl.org, cdf.org.nz (each a Website).
By using a Website, you are agree to be bound by these Terms and Conditions and all applicable laws and regulations, and you further agree that you are responsible for compliance with any applicable local laws. If you do not agree with these Terms and Conditions, you are prohibited from using or accessing a Website.

The content on a Website is provided “as is”. To the fullest extent permitted by law, the Diocese makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the Diocese does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on a Website or otherwise relating to such materials on any independent websites linked to a Website.

Limitation of liability

To the fullest extent permitted by law, the Diocese be not be liable for any lost profits or other consequential, special punitive, indirect, or incidental damages, arising from or related to your use or inability to use a Website and services, even if the Diocese or a representative of the Diocese has been notified orally or in writing of the possibility of such damage. The laws of some states or jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the exclusions and limitations herein may not apply to you. Notwithstanding anything to the contrary in these Terms and Conditions, nothing in these Terms and Conditions excludes or limits the liability of the Diocese for fraud or for death or personal injury caused by the negligence of the Diocese.

A Website may contain links to other independent websites, and these links are provided in good faith. The Diocese has no responsibility or control over the content or privacy of these independent websites, and you should verify the authenticity of the material contained in the independent websites before relying on it. If you are unsure of the authenticity of the material contained on the independent websites you can always contact the Diocese. The inclusion of any independent website link does not imply endorsement by the Diocese of the independent website. Use of any links to independent websites is at your own risk and may be subject to additional terms and conditions and privacy policies. We encourage you to review any third party terms and conditions and policies carefully when using the independent websites.

Registration

When registering for an event (either directly through a Website or using a link to an independent website), you must provide accurate and complete information, and you must not use multiple identities or personas (whether false or not). Each registration is for a single individual only, and it is your responsibility to prevent unauthorised use of your registration.
In certain circumstances, the Diocese may need to reject your registration. This may happen if registrations for an event have reached maximum capacity, if an event is no longer available, or if there is an error in the price or event description stated on a Website. If the Diocese rejects your registration through a Website, then the Diocese will endeavour to notify you of that rejection at the time you attempted to register for a specific event, or within a reasonable time after you submit your registration. In the event of an error, the Diocese reserves the right to correct such error and revise your registration accordingly (which includes charging the correct price), or to cancel your registration and refund any amount charged to you. If the Diocese discovers a pricing or other material error related to a registration, the Diocese will contact you to inform you of this error and give you the option of continuing with the registration at the correct price or cancelling your registration. If the Diocese is unable to contact you using the details you provided during the registration process, the Diocese will treat the order as cancelled.
Each registration through a Website that is accepted results in a separate binding agreement between you and the Diocese. For each registration accepted by the Diocese, the Diocese will allow your participation in an event and provide you with an email confirming your registration.
By submitting a registration, you acknowledge that you are authorised to use the designated payment method and you authorise us to charge your registration to that payment method.

Refunds

The Diocese will refund payments made that are fraudulent due to unauthorised use of a credit card or in the event that registration for an event was rejected. In all other circumstances, refunds of payments will be at the sole discretion of the Diocese and decided on a case by case basis. If any refund is required, please contact the Diocese with the details of the amount, date and name which the registration was made under.

Donations

The Catholic Diocese of Christchurch is registered with the New Zealand Charities Services as a charitable entity under its legal name, The Catholic Diocese of Christchurch Diocesan Trust (CC33341).
The role of the Charities Services, Ngā Rātonga Kaupapa Atawhai, is to promote public trust and confidence in the charitable sector and to encourage the effective use of charitable resources. This is accomplished by registering charitable organisations and monitoring the on an annual basis. The Charities Services also encourage good governance and management practices by providing educational support, advice and materials. For further information about charitable organisations, please visit the Charities Register at www.charities.govt.nz.
Any transactions made through a Website will appear as Catholic Diocese of Ch on your cardholder statements.
If for any reason a refund is required, please contact the Diocese with the details of the amount, date and name which the donation was made under. Any refunds of donations will be at the sole discretion of the Diocese and decided on a case by case basis.

The Diocese is committed to protecting the privacy of users of a Website. Please refer to the terms of the Privacy Policy.
Where your financial information is collected to process your online credit card payment, this information is collected on a secure server that uses the latest encryption technology. This information is strictly confidential, and the only people who have access to this information are the people processing your payment, being Direct Payment Solutions. Please refer to their privacy policy. Our e-commerce sites use Secure Sockets Layer (SSL) technology.
By using a Website, you acknowledge that a Website may contain links to other independent websites that the Diocese does not control and who may not share the same privacy policy safeguards as the Diocese. In addition, you acknowledge that certain third parties may collect information about you when you register for an event. The Diocese is not responsible for the accuracy of any third party’s privacy policy or for ensuring that third parties comply with their privacy policies.

The Diocese has the discretion to amend these Terms and Conditions at any time without notice. You are responsible for reviewing the amended Terms and Conditions. By continuing to use this website, you agree to be bound by the then current version of these Terms and Conditions. Governing Law

Any claim relating to the Diocese website shall be governed by the laws of New Zealand and users agree to submit to the non-exclusive jurisdiction of the New Zealand Courts.
